GW: Mr Neale was sitting on a bench waiting for a car to be MOT’ed & along comes some ”Community Police” trying to issue him with a fixed penalty. This is an essential service ffs. Just had a car MOT’ed recently. What’s wrong with that? He eventually refused to give his particulars & was arrested. However, this was not held up in Court. It was decided that Mr Neale was not placing anyone at risk however his subsequent arrest put HIM at risk. It was said that ”some police officers had misunderstood their powers under Common Law.”
